RETURN OF DEFECTIVE PRODUCT AND RIGHT OF WITHDRAWAL

Returns due to manufacturing defects.

The User can return any product with a manufacturing defect to HAWKERS, at no cost. Considering the type of products bought, the User shall enjoy a term of one month from the time at which s/he became aware of his/her lack of conformity with the product to inform HAWKERS of his/her lack of conformity with the product. Where the term was exceeded, the User shall be responsible for any damages.

The User shall incur no additional cost for the return of products with manufacturing defects.

To proceed to the return, the User must contact HAWKERS within the term of one month granted, and use the following form of contact page, stating which product(s) is/are to be returned, attaching a photograph and a detailed list of the defects found in such product(s).

Once HAWKERS receives the notice from the User, it shall inform them if the return of the product can go ahead in a term of 3 to 5 working days. If the return is applicable, HAWKERS shall inform the User on the method of collection or shipping to its offices/stores of the defective product.

Every product to be returned must be unused and have all labels, packaging and - where applicable - documents and the original accessory items provided with the product. Should the User fail to do this, HAWKERS reserves the right to refuse the return.

After receiving the product and verifying the defects, HAWKERS will offer the User the opportunity to replace the product for another one with the same characteristics, unless this option was objectively impossible or disproportionate for HAWKERS.

Where another identical product could not be sent given a lack of stock, the User may choose between terminating the contract (i.e. the return of the amounts paid) or asking for the shipping of another model of the User’s choice.

The delivery of the identical product or the new model chosen by the User, as applicable, shall be completed in the 3 to 5 working days following the date on which HAWKERS confirmed the replacement of the defective product or the shipping of a new model to the User.

The replacement, the sending of a new model or the termination of the contract shall not give rise to additional expenses for the User.

If the User terminates the contract, HAWKERS shall return the entire amount paid by the User to purchase the defective product (including shipping expenses).

HAWKERS informs Users that the term required for the return of the amounts paid depends on the method of payment employed by the User when the product was purchased:

  • If the consumer and user has paid by credit/debit card, HAWKERS will refund the amount paid within fourteen (14) calendar days after the consumer and user has decided to terminate the contract.
  • If the consumer and user has paid by PayPal, HAWKERS will refund the amount paid within twenty-four (24)-forty-eight (48) business hours after the consumer and user has decided to terminate the contract.

Withdrawal.

Should the User disagree with the products received in his/her order, the User shall enjoy a term of fourteen (14) calendar days to return the full order, according to the provisions laid down in the Spanish General Law on the defence of Consumers and Users. The User may further choose to return any of the individual products making up the full order, the above with no penalty whatsoever and with no need to state the reasons.

However, the User must take care of the direct cost of the return to HAWKERS, both when the entire order is returned and when solely one/some product(s) of the order is/are returned.

The return shall be formalised by contacting HAWKERS at the following contact form of contact page, sending the filled-out withdrawal form attached to these Terms and Conditions as ANNEX 1. After receiving this communication, HAWKERS will indicate the method of delivery of the order to its offices or stores.

The User can send the product to the following offices/stores of HAWKERS:

  • Office in Spain: Play Hawkers S.L., Travessera de Gràcia, 278 08025 BARCELONA (Spain).
  • Store in the United States: Shipwire Inc. 1409 S Lilac Ave Bloomington, CA 92316 USA.
  • Store in Australia: PLY RETURNS PO BOX 6035 CHULLORA, NSW, 1405.

HAWKERS is not responsible for the courier service employed by the User to return the order. In this connection, HAWKERS advises the User to ask for a delivery receipt once the courier service has delivered the product at the offices of HAWKERS, so that the User has proof that the product has been correctly handed over to HAWKERS. HAWKERS shall not be responsible for the address where the User sends the order for its return. For European deliveries, the address should always be our office.

The User shall be directly responsible for the return expenses of the order (such as, for instance, shipping expenses of courier services).

The product must be unused and have packaging and - where applicable - documents and the original accessory items provided with the product. If the User fails to do this or if the product had suffered any damage, the User agrees that the product may be worth less, or that HAWKERS could refuse to accept the return.

Once HAWKERS has verified that the order is in good condition, HAWKERS shall proceed to return all the amounts paid by the User.

Should the User choose to return the entire order, HAWKERS shall return the User all amounts s/he had paid (including shipping expenses).

If the User only wished to return one or some of the products in the original order, HAWKERS will be unable to return the shipping expenses paid by the User for the entire order.

HAWKERS informs Users that the term required for the return of the amounts paid depends on the method of payment employed by the User when the product was purchased:

  • If the User made the payment using a credit/debit card, HAWKERS shall return the amount paid within a term of 14 calendar days from the time at which the User agreed to terminate the contract.
  • If the User made the payment via PayPal, HAWKERS shall return the amount paid within a term of 24 to 48 working hours after the User agreed to terminate the contract.

In any event, HAWKERS shall return the amounts paid as soon as possible, within a term of up to 14 calendar days following the date on which the User notified his/her decision to withdraw from the contract.

For promotions applicable to the purchase of separate items including an extra product, including but not limited to 2 for 1, 3 for 2, or any other promotion involving the delivery of an additional free or reduced item, if the User exercised his/her right of withdrawal, this right shall be effective for the overall set of products included in the promotion.

Product Exchange Policy

HAWKERS will not accept the change of a product purchased by the User for another product being offered on this Website. Should the User wish to change the product, s/he must exercise his/her right of withdrawal as provided under clause 6.2 and then buy the new product of his/her choice.
